CHIDAMBARAM): Sir, I move: That the Bill to provide for the establishment of an Authority to promote old age income security by establishing, developing and regulating pension funds, to protect the interests of subscribers to schemes of pension funds and for matters connected therewith or incidental thereto, as passed by Lok Sabha, be taken into consideration. Sir, the PFRDA Bill, 2011, was referred to the Standing Committee on Finance on the 29th March, 2011. The Standing Committee recommended enactment of the Bill with certain modifications. The Government has decided to accept all recommendations, some fully, one partially, and is unable to accept only one recommendation. The Government has not accepted the recommendation regarding facility of repayable advances from the pension accounts of subscribers, but withdrawals have been permitted. Accordingly, the Government introduced official amendments to the PFRDA Bill, 2011. These have been accepted by the Lok Sabha and the Bill has been passed with the official amendments.

Sir, the Delimitation (Amendment) Bill, 2008 proposes to replace the Delimitation (Amendment) Ordinance, 2008. The Representation of the People (Amendment) Bill, 2008 proposes to amend the relevant provisions of the First Schedule and the Second Schedule to the Representation of the People Act, 1950 to reflect the changes in reservation of seats for the Scheduled Castes and the Scheduled Tribes as contained in the delimitation orders made by the Delimitation Commission. It will enable the Election Commission to revise the electoral rolls as per new delimitation of constituencies for future elections. As the hon. Members are aware, in 2002, the Delimitation Commission was set up to readjust the division of each State and Union Territory into territorial constituencies for the purpose of elections to the House of the People and to the State Legislative Assemblies on the basis of 2001 Census. Sir, the moments sometimes come in the life of a nation when you need to revisit the past and you embrace the future. These moments have happened in the recent past in the form of the Food Security Bill, and Land Acquisition, Rehabilitation and Resettlement Bill. One such moment is here today with reference to the amendment to article 124. Sir, the original provision of article 124 (2) stated that the President of India shall appoint Judges to the Supreme Court and the High Courts in the States in consultation with the Chief Justice of India and such of the other Judges that the President may deem necessary for the purpose. Every Judge of the Supreme Court is appointed by the President, by warrant under his hand and seal. This was incorporated in the Constitution at its inception Thereafter, Sir, after a long period of time, it was felt that the provision was not functioning or working 38 Government [RAJYA SABHA] Bills as well as it should have. In 1990, when the National Front Government came into being, for the first time they proposed that we should have a Judicial Commission for appointment of Judges to the Supreme Court and to the High Courts. That was part of the agenda of the then National Front Government. Thereafter, Sir, in 1993 the Supreme Court in the Advocates on Record Association case sought to change this procedure through an interpretation of article 124(2) of the Constitution. With the greatest respect to the Supreme Court, I do believe that in that process they rewrote the Constitution. I will just share with you what they did. Under article 124(2), the President who represents the Executive decides or has to decide who should be a Judge of the Supreme Court or of the High Court in consultation with the Chief Justice of India and other Judges.

This is a most timely measure that the Government is undertaking. Since 1991 the Indian economy has been globalizing and getting more and more integrated into the world economy. The structure of the economy, the dimensions of the economy and the relationships among different financial and industrial entities are also undergoing a change. That is why, legislations in a country prevailing upon at a particular point of time also needs to undergo change in order to accommodate the requirements of changing circumstances. That is why, I fully support all the three Bills - The Chartered Accountant (Amendment) Bill, 2010, The Cost and Works Accountants (Amendment) Bill, 2010, and The Company Secretaries (Amendment) Bill, 2010. Now, there is nothing substantial here which needs to deal with extensively. In the beginning, I must congratulate Shri Ahluwalia for most of the points that he has mentioned. I fully support them and I am inclined to agree with what he has said. Since beginning, the Chartered Accountants service has been a highly professional service and, that is why, the results of the Chartered Accountants examinations never exceeded six per cent.

THE MINISTER OF RURAL DEVELOPMENT (SHRI RAGHUVANSH PRASAD.SINGH): (a) The works that can be taken up under NREGA have been given in para 1 of Schedule-1 of the NREG Act, 2005. The State Governments will select the durable assets as per the needs of the rural people. (b) Modalities for supervising works are given in para 5.5,12.1,12.2 of the NREGA Guidelines, which include: (i) Accreditation of a panel of engineer for supervision (ii) Test check of the work of accredited engineers by Departmental engineers (iii) Technical support group at district level for quality check (iv) Technical support group at State level  Executive instructions have been given to provide one Technical Assistant for a group of ten Panchayats; dedicated solely for NREGA works. (vi) Guidelines also provide for wages of skilled labourers and mates to be included in the material cost of the programme. The mate will be responsible for the supervision on the worksite. (c) As per Section 6(2) of the NREG Act, the unskilled labour employed under the Act would be paid wages fixed by the State Governments under Section 3 of the Minimum Wages Act, 1948 for agricultural laborers till such time a wage rate is notified by the Central Government in that area NREGA guidelines indicate the steps to be taken by States to ensure payment of entitled wages such as:— (i) Weekly payment of wages (ii) Fixation of reasonable norms of work

(c) Available information indicates that members of the Memon family arrived in Pakistan in March 93. The Govern ment of Pakistan was approached for locating these persons and sending them back to India. The Government of Pakistan have so far taken the position that they are not aware of the where abouts of the Memon family.

SHRI RAJKUMAR DHOOT (Maharashtra): Sir, I beg to move for leave to introduce a Bill to provide for the protection of farmers from exploitation by moneylenders, middlemen, unscrupulous traders and others, removal of indebtedness, remunerative prices for their produce, increasing farm yield by improving farming practices by modern techniques and allied occupations, extending protective umbrella against natural calamities in which crops are lost by way of compulsory insurance of crops and livestock and provision of adequate compensation, work, food, potable water, fodder, etc. during calamity, extending compulsory market intervention in case of bumper crops, old age allowance, soft loans from Banks and other institutions and other welfare measures to be undertaken by the State so as to prevent the distressed farmers from committing suicide and for matters connected therewith and incidental thereto. AKHILESH DAS GUPTA (Uttar Pradesh): Sir, I beg to move for leave to introduce a Bill to regulate the hosting, sponsoring and advertising sports events by body corporates, persons, partnerships, associations other than recognized sports associations who spend substantial money on a single sport and take tax exemption thereon but ignore other sports and to provide for declaration of annual budget for such sports activities and spending limit of fifty per cent of the budget on a single sport so that other sports too get their due promotion and for matters connected therewith and incidental thereto.
